Final Rules

Cost or Pricing Data Threshold (DFARS Case 2000-D026)

This final rule reflects the increase in the FAR cost or pricing data threshold from $500,000 to $550,000. Since there are statutory requirements for review of the cost or pricing data threshold every 5 years, this rule replaces references to the $500,000 threshold with the phrase "cost or pricing data threshold" to minimize the need for future DFARS changes.

Domestic Source Restrictions-Ball and Roller Bearings and Vessel Propellers (DFARS Case 2000-D301)

This rule finalizes, without change, the interim rule published on December 13, 2000 (Change Notice 20001213), pertaining to domestic source requirements for the acquisition of ball and roller bearings and vessel propellers. The rule implements Section 8064 of the DoD Appropriations Act for Fiscal Year 2001 (Public Law 106-259) and Section 805 of the DoD Authorization Act for Fiscal Year 2001 (Public Law 106-398).

Cancellation of MIL-STD-973, Configuration Management (DFARS Case 2001-D001)

This final rule removes references to a cancelled military standard, which prescribed a format for preparation of engineering change proposals. The standard format is no longer necessary.

Use of Recovered Materials (DFARS Case 2001-D005)

This final rule removes approval level designations pertaining to the acquisition of items that do not meet Environmental Protection Agency minimum standards for recovered material content. These approval level designations are no longer necessary, because the underlying approval requirements have been removed from the FAR.

Memorandum of Understanding—Section 8(a) Program (DFARS Case 2001-D009)

This final rule reflects an extension in the expiration date of a memorandum of understanding between DoD and the Small Business Administration. The memorandum of understanding permits DoD to award contracts directly to 8(a) Program participants, instead of awarding the contracts through the Small Business Administration. The expiration date of the memorandum of understanding has been extended to December 31, 2001.

Customary Progress Payment Rate for Large Business Concerns (DFARS Case 2001-D012)

This final rule increases the DoD customary progress payment rate for large business concerns from 75 percent to 80 percent. The rate change is applicable only to new contracts awarded on or after October 1, 2001.

Reporting Requirements Update (DFARS Case 2001-D004)

The DFARS has been updated to incorporate the final rule published on September 11, 2001 (Change Notice 20010911), pertaining to contract action reporting requirements for Fiscal Year 2002. The rule contains reporting changes related to bundled contracts, indefinite-delivery contracts, information technology products, commercial items, and recovered materials.
