Status of Procurement Desktop-Defense Technology Sunset Date

This memorandum signed by the Under Secretary of Defense for Acquisition and Sustainment (USD(A&S)), updates previous guidance regarding a sunset date for the Procurement Desktop-Defense (PD2) technology for the Department of Defense. The update removes the previous requirement to cease issuing new awards via PD2 after September 30, 2023. For more information, please see the memorandum at the link below.

Updated Version of Performance-Based Payment Tool

Version 8.0 of the Performance-Based Payment (PBP) tool is now available. The tool, which demonstrates the financial impact to both the Government and the contractor of using PBPs versus customary progress payments, has been updated to include the current discount rates. The DPC Price, Cost and Finance “Pricing Tools” page includes access to this and other key tools for the pricing community. Operation Atlantic Resolve - Contingency Operation

On July 13, 2023, the President of the United States issued an Executive Order authorizing the activation of military reservists under title 10 U.S.C. 12304 to support Operation Atlantic Resolve (OAR). On August 18, 2023, the services issued mobilization orders, which meet the definition and criteria of "contingency operation" at 10 U.S.C. 101 (a)(13)(B) and Federal Acquisition Regulation (FAR) subpart 2.101. The orders are captured in the Execute Order (EXORD) issued by the Secretary of Defense on August 31, 2023. For more information, see the announcement at the link below.

Humanitarian Assistance and Disaster Relief for Turkey

On February 8, 2023, the Administrator of the United States Agency for International Development (USAID) requested disaster assistance support from the Department of Defense (DoD) to facilitate the provision of international disaster in response to the recent earthquake in Turkey. In accordance with Federal Acquisition Regulation (FAR) 2.101 and Defense FAR Supplement 218.270, Heads of Contracting Activity (HCAs) have been delegated the authority to determine if emergency flexibilities are warranted. On February 10, 2023, the Secretary of Defense authorized Commander, U.S. European Command to provide humanitarian assistance and disaster relief transportation and logistics support to USAID’s disaster response efforts in Turkey and approved the expenditure of up to $26 million of Overseas Humanitarian, Disaster, and Civic Aid (OHDACA) funds to support that effort. New DAU course - Inflation and Economic Price Adjustments

Defense Acquisition University (DAU) recently published a new course, CON 7470 - Inflation and Economic Price Adjustments, to instruct Acquisition Professionals on the impacts of inflation on existing contracts and proper use of economic price adjustment (EPA) clauses to manage the risk of inflation, when appropriate, in the formation of prospective contracts. This course supplements the DPC memorandum “Guidance on Inflation and Economic Price Adjustments,” issued Wednesday, May 25, 2022. Extension Authorization of Humanitarian Support to Ukraine through 31 May 2022

On April 8, 2022, the Department of Defense (DoD) extended the authorization through May 31, 2022, or until there are no validated humanitarian requirements for the Department, for Commander, United States European Command (USEUCOM) to provide humanitarian support to Ukraine pursuant to 10 U.S.C. 2561 as a result of Russian military action. This authorization for humanitarian assistance meets the definition of “humanitarian or peacekeeping operation” at FAR 2.101. Additionally, contracting officers supporting the humanitarian operation are authorized to use the Government-wide commercial purchase card to make a purchase that exceeds the micro-purchase threshold but does not exceed the simplified acquisition threshold as long as the criterion at DFARS 213.301(3) are met, National Interest Action (NIA) Code “O22U” shall be used as a means of tracking acquisitions associated with this event. Striking the Balance – Subcontracting

On December 15, 2021, from 1300 to 1500, join DAU faculty Dr. Renee Butler for a special edition of the DPC "Striking the Balance" series featuring Ms. Shannon Prince, Procurement Analyst specializing in cost/price analysis with the Field Support Team with Headquarters Air Force, SAF/AQCP. Ms. Prince will discuss the importance of striking the balance between recognizing the Prime's responsibility for awarding subcontracts to responsible sources at reasonable prices, with the Contracting Officer's responsibility to provide goods and services to support the warfighter at fair and reasonable prices for the taxpayer. Operation ALLIES WELCOME

As of August 29, 2021, Operation ALLIES WELCOME (OAW) is a continuation and renaming of Operation ALLIES REFUGE (OAR), with the task of managing the resettlement of refugees and providing "temporary housing, sustainment, and support inside the United States" for evacuees. OAW meets the definition of “contingency operation” at FAR 2.101 pursuant to SecDef approved Execute Order (EXORD) (Revision 1) dated October 4, 2021 (available on SIPR). The National Interest Action Code “O21R” shall still be used as a means of tracking acquisition costs for OAR and OAW. For more information, see the announcement link below.

2020 DoD Procure-to-Pay Training Symposium Schedule Status Update

We appreciate your continued patience in the coordination of the 2020 DoD Procure-to-Pay Financial Audit Training Symposium. At this time, we are proceeding with holding the Symposium in June as scheduled, however we will send a status update to all attendees no later than May 13, 2020.

This decision is based on the recent guidance from the Secretary of Defense related to travel in response to Coronavirus 2019 that states all forms of movement will cease for 60 days. Our conference dates, June 9-11, 2020, are beyond the period of prohibited travel.

Again, we will update this message and keep participants informed as necessary to ensure notification occurs well in advance of incurring any reservation penalties.

On November 20, 2019, Ms. LeAntha Sumpter was awarded Excellence in Partnership’s Lifetime Acquisition Excellence Award. The Excellence in Partnership Awards honor individuals in the acquisition community who have made significant contributions to the procurement system that deliver best value and meet agency missions. As a Lifetime Acquisition Excellence Awardee, Ms. Sumpter demonstrated a life-long commitment to advancing “common-sense in government procurement.”

DoD, GSA, and NASA are issuing an interim rule amending the Federal Acquisition Regulation (FAR) to implement section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2019 (Pub. L. 115-232). Section 889(a)(1)(A) prohibits agencies from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as a critical technology as part of any system, on or after August 13, 2019.

A prepublication version of the interim FAR rule that has been sent to the Federal Register is being posted early by DoD, GSA, and NASA. Formatting or other administrative changes may be made by the Federal Register prior to publication. Although DoD, GSA, and NASA have taken steps to ensure the accuracy of this prepublication version, it is not the official version.
