Second interim rule amending the Federal Acquisition Regulation (FAR) to require an offeror to represent annually, after conducting a reasonable inquiry, whether it uses covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services. The new annual representation in the provision implements a section of the John S. McCain National Defense Authorization Act for Fiscal Year 2019.

Section 889(a)(1)(B) prohibits contracting with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This memorandum provides guidance to DoD contracting officers to facilitate implementation of the interim FAR rule.

This memorandum provides DoD-specific procedures associated with the interim FAR rule that implements section 889(a)(1)(A) of the National Defense Authorization Act (NDAA) for Fiscal Year 2019. Contracting officers shall include the provision at FAR 52.204-24 and the clause at FAR 52.204-25 in solicitations issued- . On or after August 13, 2019, and resultant contracts, task orders, or delivery orders; and . Before August 13, 2019, provided award of the resulting contracts, task orders, or delivery orders occurs on or after August 13, 2019. Contracting officers shall only include the clause at FAR 52.204-25 in- . Contracts issued on or after August 13, 2019; . Modifications to extend the period of performance (including exercising an option) of a contract, task order, or delivery order beyond August 12, 2019; and . Indefinite delivery contracts when orders are to be issued on or after August 13, 2019, prior to placing any order.
