ADVANCE NOTICE OF PROPOSED RULEMAKING:


Modifications to Printed Circuit Board Acquisition Restrictions (DFARS Case 2022-D011)


DoD is seeking information from experts and interested parties in the Government and the private sector that will assist in the development of a revision to the DFARS to implement section 841 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2021 and section 851 of the NDAA for FY 2022. Section 841 prohibits the acquisition of covered printed circuit boards from a covered nation. Section 851 extends the effective date of the prohibition from January 1, 2023, to January 1, 2027, and addresses applicability to commercial products.

On June 25, 2026, DoD published the following changes to the DFARS:

PROPOSED RULES:


Small Purchase Exception for the Acquisition of U.S. Flags (DFARS Case 2024-D013)


DoD is proposing to amend the DFARS to implement section 832 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2024, section 843 of the NDAA for FY 2025, and section 831 of the NDAA for FY 2026. Section 832 amends 10 U.S.C. 4862 (known as the Berry Amendment) to require DoD to procure U.S. flags that are produced in the United States, except purchases at or below $10,000. Section 843 clarifies that the exception at 10 U.S.C. 4862 applies to procurements by, or for, vessels in foreign waters. Section 831 narrows the commissary-resale exception at 10 U.S.C. 4862, so that the exception does not apply to seafood originating in certain countries. This proposed rule implements these requirements.

Certification Requirement for Military Recruitment Advertising (DFARS Case 2024-D022)


DoD is proposing to amend the DFARS to implement section 1555 of the NDAA for FY 2024, section 1542 of the NDAA for FY 2025, and section 1541 of the NDAA for FY 2026. Section 1555 adds a certification requirement for offerors and a requirement for DoD to notify congressional defense committees of certain DoD contracts related to the placement of military recruitment advertising. Section 1555 also specified a sunset date of one year after the date of enactment of the NDAA for FY 2024. Section 1542 extended that date to two years after the date of enactment of the NDAA for FY 2024. Section 1541 removed the congressional notification requirement and extended the sunset date to December 31, 2030. This proposed rule implements the certification requirement and the extended sunset date.

On May 7, 2026, DoD published the following changes to the DFARS:

FINAL RULE:


Disclosure of Greenhouse Gas Emissions (DFARS Case 2024-D021)


DoD is issuing a final rule amending the DFARS to implement section 318 of the National Defense Authorization Act for Fiscal Year 2024. Section 318 prohibits DoD contracting officers from requiring, as a condition of contract award, nontraditional defense contractors to disclose a greenhouse gas inventory or any other report for greenhouse gas emissions, unless DoD determines that such disclosure is necessary to verify a voluntary disclosure relating to greenhouse gas emissions. A waiver is permitted on a contract-by-contract basis, provided that the information relating to greenhouse gas emissions is directly related to the performance of the contract. This final rule implements these requirements in DFARS subpart 223.5.

PROPOSED RULE:


Mitigating Risks Related to Foreign Ownership, Control, or Influence (DFARS Case 2021-D011)


DoD is proposing to amend the DFARS to implement part of section 847 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2020 and part of section 819 of the NDAA for FY 2021 to mitigate risks related to beneficial ownership or foreign ownership, control, or influence (FOCI). Section 847 of the NDAA for FY 2020 requires contractors and subcontractors to disclose their beneficial ownership and whether they are under FOCI, as well as related changes during contract or subcontract performance and the effective mitigation of FOCI-related risks for the duration of the contract or subcontract. Section 847 also allows these requirements to apply to contracts for commercial products and commercial services under certain circumstances. This proposed rule implements the disclosure and risk mitigation requirements of section 847 via a solicitation provision and a contract clause.

FINAL RULE:


Preventing Conflicts of Interest for Certain Consulting Services (DFARS Case 2024-D007)


On August 25, 2025, DoD published the final rule for DFARS Case 2024-D007, effective October 24, 2025, to implement section 812 of the National Defense Authorization Act for Fiscal Year 2024. Section 812 prohibits DoD from awarding contracts for certain consulting services to offerors who hold contracts that involve consulting services with covered foreign entities.

Inflation Adjustment of Acquisition-Related Thresholds (DFARS Case 2024-D002)


On August 25, 2025, DoD published the final rule for DFARS Case 2024-D002, effective October 1, 2025, to further implement the requirement at 41 U.S.C. 1908 to adjust acquisition-related thresholds for inflation. The objective of the rule is to maintain the status quo by adjusting acquisition-related thresholds to account for the changing value of the dollar.
