SUPPLEMENT (DFARS) Change Notice 20030603
DoD has published the following final and
proposed DFARS rules in the Federal Register:
Final Rule:
Transportation of
Supplies by Sea – Commercial Items (DFARS Case
2002-D019)
Changes the DFARS
to add an alternate version of a clause, pertaining to the transportation
of supplies by sea, this alternate clause is added to the list of clauses included in contracts for commercial
items to implement statutory requirements.
The alternate clause requires contractors to use U.S.-flag vessels
when transporting supplies by sea under contracts for commercial items
at or below the simplified acquisition threshold, but requires less documentation
from contractors under these contracts than is required for higher dollar
value contracts.

Competition Requirements for Purchases from a
Required Source (DFARS Case 2002-D003)
Proposes DFARS changes to address
requirements for purchase of products from Federal Prison Industries, Inc. (FPI). The changes (1) clarify
requirements for conducting market research before purchasing a product listed
in the FPI catalog; (2) specify requirements for use
of competitive procedures or for making a purchase under a multiple award
contract if an FPI product is found to be noncomparable to products available from the private
sector; (3) specify that a contracting officer’s determination, regarding the
comparability of an FPI product to products available
from the private sector, is not subject to the arbitration provisions of FAR
8.605; (4) specify that a DoD contractor may not be required to use FPI as a subcontractor; and (5) prohibit the award of a
contract to FPI that would allow an inmate worker
access to classified or sensitive information.

Information Assurance (DFARS
Case 2002-D020)
Proposes DFARS changes to update policy pertaining to information
assurance in the acquisition of information technology. The proposed
changes implement policy issued by the National Security Telecommunications and
Information Systems Security Committee. DoD has issued related guidance in DoD Directive 8500.1,
Information Assurance, and DoD Instruction 8500.2, Information Assurance
Implementation.

Follow-On Production Contracts for Products
Developed Pursuant to Prototype Projects (DFARS Case
2002-D023)
Proposes
DFARS changes to permit award of a follow-on
production contract without competition, if (1) the “other transaction”
agreement for the prototype project provides for a follow-on production
contract; (2) the quantities and prices for the follow-on production contract
do not exceed the quantities and target prices established in the other
transaction agreement; (3) and the other transaction agreement meets certain
other conditions of law.
