The BAA training module is intended to demystify FAR Part 25 and DFARS 225 by providing explanatory materials and practical examples to clarify the main issues. - Determination by the Under Secretary of Defense (Acquisition, Technology, and Logistics), dated March 14, 2002 , that, for procurements subject to the Trade Agreements Act, it would be inconsistent with the public interest to apply the Buy American Act to U.S.-made end products that are substantially transformed in the United States. This is implemented at DFARS 225.103(a)(i)(B), and DFARS 225.502(b).
- Secretary of Defense memorandum, dated March 7, 1964, establishing a 50 percent evaluation factor as part of the Balance of Payments Program. This is implemented at DFARS 225.105(b).

(d)(1) When the contracting officer obtains the approval from the senior procurement executive (this authority is not delegable) to allow for the application of an alternate domestic content test for the contract, the contracting officer shall ensure the documentation evidencing the senior procurement executive’s consultation with the Office of Management and Budget’s Made in America Office and subsequent allowance for the application of an alternate domestic content test is included in the contract file.
